Welcome to AI TattooInk. These Terms of Use ("Terms") govern your access to and use of the AI TattooInk mobile application (the "App") provided by AI TattooInk ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age (or the applicable age of consent in your jurisdiction) and agree to comply with these Terms. If you do not agree, you must not use the App.
2. Description of Service
AI TattooInk is an AI-powered tattoo design application that allows users to:
- Generate custom tattoo designs from text descriptions using artificial intelligence.
- Browse and explore various tattoo styles and categories.
- Preview tattoo designs on their body using augmented reality (AR).
- Save, share, and manage their tattoo design collections.
3. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to notify us immediately of any unauthorized use.
4. Subscriptions and Payments
Some features of the App may require a paid subscription. Subscriptions are billed through Apple's App Store. By purchasing a subscription, you agree to the following:
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in your App Store account settings.
- Any unused portion of a free trial period will be forfeited when you purchase a subscription.
5. Intellectual Property
The App, including its design, code, AI models, user interface, and branding, is the property of AI TattooInk and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
6. User-Generated Content
You retain ownership of the text prompts you submit. However, by using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your prompts for the purpose of generating tattoo designs and improving our services.
AI-generated tattoo designs created through the App are provided for your personal use. You may use generated designs as reference material for actual tattoos. You may not claim AI-generated designs as solely your own original artwork for commercial resale purposes.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws.
- Generate content that is offensive, hateful, discriminatory, or promotes violence.
- Attempt to reverse-engineer, decompile, or extract the AI models or algorithms.
- Interfere with or disrupt the App's functionality or security.
- Use automated systems or bots to access the App.
- Impersonate another person or entity.
- Share your account credentials with others or allow unauthorized access.
8. AI-Generated Content Disclaimer
Tattoo designs generated by our AI are created algorithmically and may not always meet your expectations. We do not guarantee the uniqueness, accuracy, or suitability of any generated design. AI-generated designs are intended as inspiration and reference; final tattoo decisions should be made in consultation with a professional tattoo artist.
9. AR Try-On Feature
The AR Try-On feature provides an approximate preview of how a tattoo may look on your body. The preview is for visualization purposes only and may not accurately represent the final appearance of an actual tattoo due to differences in skin tone, body contours, tattoo artist technique, and other factors.
10. Limitation of Liability
To the maximum extent permitted by law, AI TattooInk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, dissatisfaction with generated designs, decisions made based on AR previews, or any outcomes related to actual tattoos obtained using our designs as reference.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately. You may delete your account at any time by contacting us.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
